Somnivet Inc. (“Somnivet,” “we,” “us,” or “our”) is committed to respecting and protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use the Somnivet website, platform, and associated services (collectively, the “Services”).

1. Our Role: Controller vs. Processor

To ensure transparency, Somnivet distinguishes between the different roles it may assume:

  • As a Data Controller: When you visit our website, subscribe to communications, or manage a subscription, Somnivet determines how and why your personal information is processed.
  • As a Data Processor (Service Provider): When veterinary practices use the platform for clinical workflows, the practice is the Data Controller of the data entered into the system (including patient and client data). Somnivet acts solely as a Service Provider, processing this data on behalf of the organization to deliver the Services.

2. Information We Collect

We limit the collection of personal information to what is strictly necessary for the purposes outlined in this policy.

2.1 Information We Collect About You (Controller Role)

When you interact with Somnivet, we may collect:

  • Identity and Contact Data: Name, email address, postal address, phone number, professional title
  • Financial Data: Billing and payment information related to subscriptions
  • Account Data: Login credentials and account preferences

2.2 Data We Process on Your Behalf (Processor Role)

Through the platform, veterinary organizations may input and manage:

  • Clinical Data: Information related to veterinary patients, procedures, and anesthesia records
  • Client Data: Contact details of pet owners

Somnivet processes this data solely to provide the Services and applies safeguards appropriate to its sensitivity.

2.3 Automatically Collected Information and Cookies

When you access our website, certain technical information may be collected automatically, including IP address, browser type, and operating system.

Strictly Necessary Technologies Only:
Somnivet does not use cookies or tracking technologies for marketing or profiling purposes. Only strictly necessary cookies required for the operation and security of the Services are used. As a result, no cookie consent banner is required at this time.

3. How We Use Your Information

Somnivet uses personal information to:

  • Provide, maintain, and support the Services
  • Process transactions and manage subscriptions
  • Communicate service updates or requested information
  • Comply with legal and regulatory obligations

3.1 Product Improvement and Artificial Intelligence (AI)

Somnivet may use data generated through the platform to improve its services and clinical tools.

  • AI Training: Somnivet does not use identifiable personal information to train artificial intelligence models without explicit consent.
  • Data Processing for Improvement: For development and improvement purposes, Somnivet may use data that has been anonymized or de-identified in accordance with applicable laws and industry standards, such that it cannot reasonably be used to identify individuals, patients, or practices.

Somnivet does not sell personal information. Personal information may be shared only in the following circumstances:

  • Service Providers: With trusted third-party providers (e.g., hosting, infrastructure) who require access to deliver services and are bound by confidentiality and data protection obligations
  • Legal Requirements: When required by law, court order, or to protect rights and safety

5. Cross-Border Data Transfers

Somnivet or its service providers may process or store data outside of Quebec or Canada.

Before transferring personal information outside Quebec, Somnivet conducts a Privacy Impact Assessment (PIA) to ensure that the information will receive protection equivalent to that required under applicable laws.

Somnivet implements appropriate technical, administrative, and physical safeguards, including encryption and access controls, to protect personal information.

In the event of a confidentiality incident presenting a risk of serious harm, Somnivet will take appropriate measures in accordance with applicable laws, including notifying affected individuals and relevant authorities where required.

6.2 Data Retention

Personal information is retained only for as long as necessary to fulfill the purposes described in this policy or to comply with legal obligations. When no longer required, data is securely deleted or anonymized.
